ICC Rejects Duterte’s Bid for Interim Release For a Second Time

The Appeals Chamber of the International Criminal Court (ICC) rejected Rodrigo Duterte’s appeal for an interim release on Friday, November 28. This comes two months after the court first dismissed a request from Duterte to be released.

Article 59 of the Rome Statute states that an arrested person has the right to apply for interim release, but the ICC’s Pre-Trial Chamber must be assured that the person will not escape, and may request periodic status updates on their release.

The Pre-Trial Chamber has already denied Duterte’s release in September, citing the necessity of his appearance in the upcoming trial and the Duterte camp’s continued use of the word “kidnapping” to refer to his arrest and detainment in March.

The former president now remains in the ICC’s detention facility in The Hague, the Netherlands, as he continues to await trial for crimes against humanity in relation to the war on drugs and extrajudicial killings.
